Product Alert MinSURG Corporation has received information that a facet fusion device that is virtually identical to our TRUFUSE® facet fusion product is being marketed under the confusingly similar NUFUZE, BIOFUZE and/or NUFIX brands by Nutech Medical, Inc. or NuFix, Inc., both directly and through third party distributors. Confusion may exist as to whether these products are associated with TruFUSE products. They are not. NuFuze, BioFuze and NuFix products (“Nutech Products”) are not produced, marketed, or endorsed by or affiliated with TruFUSE products. Further, it has been represented that Nutech Products can be implanted using TruFUSE surgical instruments. TruFUSE surgical instruments are designed for use with TruFUSE allografts only. MinSURG does not endorse or permit use of TruFUSE instruments with any product other than genuine TruFUSE facet fusion allografts and disclaims any liability for improper use. MinSURG and its parent company, Orthopedic Development Corporation, have initiated legal action against Nutech Medical, Inc., NuFix, Inc. their principal, Ken Horton, and employee, Todd Gilbert, charging, among other things, trade secret misappropriation, trademark infringement, unfair competition and false advertising based on, in part, their producing and marketing these similar products.
